(“Dynaflows”) collects through the website Daxia (hereinafter, the “Website”), how Dynaflows processes your personal data, who it transfers and/or communicates your personal data to and the rights you have as the owner of the personal data.

Dynaflows, CUIT Nº 30-71245283-4, located at Av. del Libertador 4980, 7th Floor, Office “B”, City of Buenos Aires, Argentina, is the entity responsible of the processing of your personal data and of the database in which your personal data will be stored.

You provide your explicit, voluntary, unequivocal and informed consent to the processing (automated or not automated) by Dynaflows of the personal data that derives from your access and/or use of the Website, according to the terms of this Privacy Policy.

I. COLLECTED DATA

Though the Website, Dynaflows collects certain data, including personal data that could, directly or indirectly, identify you:

  • – Information regarding your location, such as the imprecise location (location based on your IP address or data that indicates a city or postal code).

Dynaflows presumes, and you guarantee, the truthfulness of the information you have provided through the Website.

Dynaflows does not verify, and does not undertake the obligation to verify, the truthfulness, validity, sufficiency, lawfulness and authenticity of the information you have provided through the Website. You are solely and exclusively responsible for the information you have provided to Dynaflows and of the consequences that could result from any inaccuracy or falseness of such information.

II. PURPOSES FOR PROCESSING

You consent to your personal data being collected, processed and stored by Dynaflows for the following purposes, in complete compliance with the applicable laws:

  • – Provide our products and/or services. This includes, but is not limited to, identifying you and contacting you, registering you in our systems, verifying your identity to comply with legal requirements, providing you with the products and/or services you request or contract, and preparing and maintaining a record of the transactions you have made.
  • – Make advertisements and promotional contacts. This includes, but is not limited to, contacting you through different channels (through email, text messages, phone calls and any other means that exists or can exist in the future) for advertising, marketing and/or promotional purposes of Dynaflows’ and/or third parties’ products and services, and to make any kind of marketing activities, advertising, commercial research and/or market studies.
  • – Comply with legal obligations and requirements from competent authorities. This includes, but is not limited to, complying with laws and regulations that are applicable to Dynaflows in general, with tax collection, registration, information, audit and billing systems, at any level of government, and with informative requirements from the competent judicial or administrative authorities.

III. INFORMATION WE SHARE

The information we collect may be shared with third parties in accordance with the terms described in this Privacy Policy:

  • – Related companies. We share information with entities that belong to our corporate group, that operate under the same internal processes and policies, including entities that are controlled by, that control or that are affiliates of Dynaflows, in order to provide services, comply with our internal regulations, prevent fraud, manage risks and facilitate the management and supply of Dynaflows’ services and products.
  • – Service providers. We share information with other companies that we engage to provide services for us or to provide services on our behalf, following our instructions and in accordance with the terms of this Privacy Policy. These services contribute to improve or facilitate transactions. These service providers have access to the information that is necessary for them to provide the services they were hired to provide, and they cannot use that information for purposes other than those agreed to with Dynaflows.

We share information with companies that have a collaboration or alliance relationship with Dynaflows, and that help us develop or improve our activities -and to fulfill the purposes indicated above-, with the purpose of offering promotions, products and services of these companies or co-branded.

Dynaflows is not responsible for the data and privacy practices of its business partners.

  • – Merger or acquisition. We may share your information and data as part of any process of merger, acquisition or sale of Dynaflows’ assets, as well as in the unlikely situation of insolvency, payment suspension or bankruptcy, in which the data should be transferred as one of Dynaflows’ assets.
  • – Public authorities. We share information with administrative and judicial authorities that, exercising their power, require information from Dynaflows, the companies that belong to our corporate group, our service providers and/or our business partners, even if there is no executive or judicial order or citation to that effect, with the purposes of: (a) collaborating in an investigation and reporting fraud, piracy, violations of intellectual or industrial property rights or any other unlawful act, as well as any activity or circumstance that could result in legal responsibility for Dynaflows and/or its users; (b) safeguarding a public interest, procurement or administration of justice, acknowledgement, exercise or defense of a right in a judicial or administrative process, and/or the resolution of disputes; and (c) compliance with any applicable law, regulation or legal provision, or with any well-founded and justified requirement from a competent authority.

The information collected can be assigned or transferred to a third party for the fulfillment of the purposes indicated in this Privacy Policy in the manner established in this Privacy Policy. In this sense, you understand and consent to the transfer of your data to countries or jurisdictions that do not have the same data protection regulations that exist in Argentina, and consequently may not provide the same level of protection to your personal data. When we transfer your personal data outside of Argentina, we will protect it by implementing safeguards to ensure an adequate level of protection.

IV. INFORMATION STORAGE

The personal data you have provided will be stored by Dynaflows in order to fulfill the purposes outlined in this Privacy Policy, under strict security and confidentiality measures, and will be destroyed by Dynaflows when they are no longer necessary or relevant in relation with the purposes that caused their collection. Your information will be kept if it is required by applicable laws.

Dynaflows complies with the personal data protection security regulations, specifically with Argentine Law N° 25.326 of Personal Data Protection and Resolution N° 47/2018 of the Agency of Access to Public information. In this sense, Dynaflows implements administrative, technical, logical and physical security measures that are designed to protect personal data from their accidental, illegal or unauthorized destruction, loss, alteration, access, communication or use.

You acknowledge, however, that the security measures adopted by Dynaflows are not unbreakable and that Dynaflows’ databases could be subject of manipulation, destruction or loss of information.

V. YOUR RIGHTS

You can access, modify, eliminate and update your personal data any time you want, by contacting Dynaflows according to the following terms. You can access the information you have provided to Dynaflows, without cost, every 6 months, except if you prove that there is a legitimate interest to that effect in the terms of Argentine Law N° 25.326 of Personal Data Protection.

In case your personal data is incorrect or if you wish to update and/or suppress your data, you may send your request asking that the data be corrected, updated and/or suppressed to Dynaflows and Dynaflows will correct, update and/or suppress that information without cost. To exercise your rights to access, rectification, update or suppression, according to the terms of Argentine Law N° 25.326 of Personal Data Protection, you should contact Dynaflows by email at support@daxiaplatform.com, indicating which right you are exercising and providing proof of your identity (for example, by sending a digital copy of your national identification document).

The AGENCY OF ACCESS TO PUBLIC INFORMATION, as the Regulating Entity established in Argentine Law N° 25.326, has the power to address complaints and reports filed by whoever is affected in their rights by any violations of the applicable personal data protection laws.
